Privacy policy

This policy sets out what personal information LazyMagnet Limited (NZBN 9429030322615) collects, why, who it is disclosed to, how long it is held, and how to access, correct or delete it. We are a New Zealand company and we comply with the Privacy Act 2020.

Which part of this policy applies to you

Your information reaches us in one of two ways. Your rights are the same in both.
You contacted us. You completed a form on this website, texted our number, messaged us on social media, emailed us, or booked a demo. We hold that information as our own and we deal with your requests directly.
You contacted a business that uses LazyMagnet. You enquired with a tradesperson, clinic or other business and the reply came from a system we operate for them. That information is theirs and we hold it on their behalf. Under the Privacy Act, information we hold as their agent is treated as held by them. We will act on your request and will refer it to that business, who decide what happens to it. Tell us who you contacted if you know. If you do not, we can locate it from your phone number or email address.

What we collect

When you contact us
  • Your name, email address, phone number and business name.
  • The content of your enquiry, including anything you tell us about your business.
  • The full text of your conversation with us, including messages sent and received by our AI agent, across text, email, web chat and social media.
  • Your appointment details, if you book one.
  • Payment details if you become a customer, handled by our payment provider. We do not store your full card number.
When you use this website
  • The pages you visit, the page you arrived from, your approximate location, and your device and browser.
  • Cookies and similar tracking, described in Cookies and tracking below.
  • Your IP address and browser details.
When a business that uses LazyMagnet holds your information
  • The information that business collects. Usually your name, contact details, the subject of your enquiry, the conversation, and your appointments with them.
  • Where that business is a clinic, this may include health information, to which the Health Information Privacy Code 2020 applies. The clinic determines how it is used. We hold it on their behalf and do not use it for any other purpose.
We do not obtain information about you from other sources, and we do not purchase contact lists.

Why we collect it

  • To respond to your enquiry.
  • To book appointments and send reminders.
  • To follow up where you have asked us to, or where you are a customer.
  • To supply, operate and support the service.
  • To take payment and keep the tax records we are required to keep.
  • To keep the service secure and investigate misuse.
  • To improve the service, using information about how it performs rather than about you.
We do not use your information for any purpose unrelated to the one it was collected for without asking you first.

How we collect it

We collect it from you when you provide it. Every form and every point at which you can start a conversation with us links to this page.

Providing your information is voluntary. Without your contact details we cannot respond to you.

Who else sees it

We do not sell, rent or trade your personal information.
We disclose it to:
  • Our service providers. The platform holding our customer records, calendars, forms and messaging. The AI service generating our agent's replies. Our text, email and phone providers. Our payment provider. Our website host. Each is permitted to use it only to provide that service to us, and not for their own purposes.
  • Advertising platforms. Facebook and Google receive information about your visit to this website. Cookies and tracking below sets out what they receive.
  • Anyone you have asked us to disclose it to, and anyone we are legally required to disclose it to, including under a court order or lawful request from a government agency.

Cookies and tracking

This website runs tracking on every page.
  • A Facebook tracking pixel runs in your browser on every page and reports your visit to Meta, which uses it to measure our advertising and to target advertising.
  • A tag container loads the tracking on the page.
  • Form submissions are sent to Meta from our server as well as from your browser. This includes your IP address and browser details along with the enquiry, on every submission. Your information leaves New Zealand at the point of submission.
  • We report to the advertising platforms when an enquiry results in a booked appointment. We send only what is needed to match the booking to the original click, not the content of your conversation.
  • Analytics records which pages are read and where visitors came from.
How to stop it. You can disable or clear cookies in your browser settings, and manage what Meta and Google do with your information in your Facebook and Google account settings. The site functions without the tracking. We do not respond to browser "Do Not Track" signals.

Where your information is held

Your information is held and processed overseas, not in New Zealand.
Our own systems run in Australia. Everything else is held by the companies whose platforms the service is built on, which are overseas companies based mainly in the United States: the system holding customer records and conversations, the AI generating replies, the advertising platforms, and our payment and messaging providers. Some operate worldwide networks, so information may pass through other countries.
Where we disclose personal information to a provider outside New Zealand, we use only providers required to protect it to a standard comparable to the Privacy Act, and their contracts with us provide for this.

How long we keep it

  • If you enquired and did not become a customer: 24 months from your last contact with us.
  • If you are or were a customer: for the duration of the service, and 12 months after it ends.
  • Conversation history: 24 months from the last message.
  • Tax and payment records: seven years, as required by New Zealand tax law. These are retained even where you ask us to delete everything else, and are not used to contact you.
  • Website tracking: for as long as the advertising platforms retain it, under their policies rather than ours.
At the end of a retention period we delete the information or anonymise it so that it no longer identifies you.

Security

Access is limited to those who require it to perform their role. Our systems require a login, and accounts holding personal information use two-factor authentication where the platform supports it. Information is encrypted in transit. Our providers are responsible for the security of their own platforms.
No system is completely secure and we do not represent otherwise.

Access, correction and deletion

You may request a copy of the personal information we hold about you, and may request that we correct it.
To access or correct it, email [email protected] with "Privacy request" in the subject line, stating the email address or phone number the information is held against. We will respond within 20 working days. There is no charge.
To request deletion, email [email protected] with "Data deletion request" in the subject line, and include:
  • the email address or phone number the information is held against, and
  • the business name, if you were contacted by a business that uses LazyMagnet.
We will acknowledge the request within two working days and complete deletion within 30 days. This covers your contact record, your message history and any form submissions associated with you.
What cannot be deleted. Records we are legally required to retain, being tax invoices, payment records, and a record that the deletion request was actioned. None of these are used to contact you.
Limits. Deletion here does not remove your information from platforms you or the business you contacted use directly, such as Facebook or Google. You must request that separately, in their own settings.
Where we hold your information on behalf of a business that uses LazyMagnet, we will action your request and notify that business.

Marketing messages

If you become a customer, or ask us to stay in touch, we may send you messages by text or email.
Each message identifies the sender and includes a means of stopping it. Reply STOP to a text, or use the unsubscribe link in an email. This is required by the Unsolicited Electronic Messages Act 2007, and we require the same of customers who use our service to message their own customers.
Stopping marketing messages does not stop operational messages such as appointment reminders or replies to your enquiries.

Automated replies

Most first replies from us are generated by an AI agent rather than a person. It works from information about our business, stores what you send it, and a person may join the conversation at any time. The full conversation is visible to us.
We do not use AI alone to make decisions about you that have a legal effect. If you would prefer to deal with a person, tell us and one will take over.

Privacy breaches

If there is a privacy breach likely to cause serious harm, we will notify the Office of the Privacy Commissioner and the people affected, as the Privacy Act requires.

Children

The service is sold to businesses and is not directed at children. We do not knowingly collect information about anyone under 16. If you believe we have, tell us and we will delete it.

Complaints

Changes to this policy

If we amend this policy we will update the date above. Where an amendment is significant we will notify customers before it takes effect.
